Validity<\/b><\/p>

The business relationship with our customers is exclusively governed by the following general terms and conditions. These are exclusively valid for our Alternative Horseshoe Technology store and are accepted by you when placing an order. Changes or additions to these general terms and conditions are only effective if they are confirmed by us in writing. The customer is a consumer if he concludes the legal transaction for a purpose that can be attributed neither to his commercial nor his independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the contract, acts in the exercise of his commercial or independent professional activity.<\/span><\/p>

Offers and conclusion of contract<\/b><\/p>

The offers, information and descriptions contained in the store are subject to change and non-binding. Errors excepted. After sending the order, rbCarbon sends an automated confirmation of receipt by e-mail. This documents that the order has been received and does not represent acceptance of the order. An effective contract is only concluded by delivery of the ordered goods or a separate written order confirmation.<\/span><\/p>

Prices<\/b><\/p>

All sales prices stated in the store are final retail prices in Euro including the applicable German VAT.<\/span><\/p>

Delivery<\/b><\/p>

Delivery is ex works \/ warehouse rbCarbon – Erdweg. The shipment of all packages within Germany is usually carried out by DHL or DPD.\u00a0 We are entitled to partial deliveries. Subsequent deliveries are free of charge for the customer. The standard delivery time is 2-4 working days. We are not liable for compliance with delivery dates, unless such a date has been confirmed in writing. In case of damage and\/or missing content, the customer must immediately report the issues to the delivering parcel service, or to the company rbCarbon.<\/span><\/p>

Shipping cost<\/b><\/p>

For domestic shipments we charge 6.00\u20ac shipping (incl. VAT) per package up to a gross value of goods of 199.99\u20ac .<\/span><\/p>

From 200,00\u20ac gross value of goods the shipping is free.<\/span><\/p>

Higher shipping cost to other European countries will be displayed when ordering. The shipping cost are confirmed by the customer with the purchase.<\/span><\/p>

Payment<\/b><\/p>

Payment of the purchase price is due immediately after conclusion of the contract.<\/span><\/p>

Payment can be made by cash in advance, direct debit, or Paypal. When using Paypal, it is mandatory to wait the re-routing back to our store site after completion of the payment confirmation, so that your order can be processed properly.<\/span><\/p>

Delivery to non-European countries will only be made by prior arrangement. Shipment of goods only after payment received.<\/span><\/p>

Warranty for material defects\/guarantee<\/b><\/p>

The warranty period follows legal provisions and begins with the date of delivery. The purchaser undertakes to inspect the delivered goods immediately and to report any material defects to rbCarbon immediately. Your warranty claims are initially limited to remedy. Multiple remedy is permissible. In case of failure of the remedies you have the choice to withdraw from the purchase contract or to reduce the purchase price. Excluded is the warranty for defects caused by incorrect handling or by external impact. A guarantee for the delivered products only exits if this was expressly given in the order confirmation for the respective article.<\/span><\/p>

Since our adhesive tabs and horseshoes are manufactured in a semi-automated process with manual work, small deviations in comparison to each other are in the norm.<\/span><\/p>

Liabilities<\/b><\/p>

Claims and compensations of the customer for damages are excluded. Excluded from this are claims for damages of the customer arising from injury to life, body, health or from the violation of essential contractual obligations as well as liability for other damages based on an intentional or grossly negligent breach of duty by rbCarbon, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the objective.<\/span><\/p>

In the event of a breach of material contractual obligations, rbCarbon shall only be liable for the foreseeable damage typical for the contract if such damage was caused by simple negligence, unless the customer’s claims for damages are based on injury to life, body or health.<\/span><\/p>

These limitations of liability shall also apply in favor of the legal representatives and vicarious agents of rbCarbon if the claims are asserted directly against them.<\/span><\/p>

Regulations of EU product liability legislation remain unaffected.<\/span><\/p>

Right of withdrawal\/right of return for consumers<\/b><\/p>

As a consumer, you can cancel your order within a 14-day period without giving any reason. The period begins at the earliest on the day after receipt of the goods, if at this time the customer has already received the cancellation policy information. The revocation can be made by returning the goods to the company rbCarbon or by declaring the revocation in text form (e-mail, fax or letter) to the company rbCarbon. The timely dispatch of the goods or the revocation is sufficient to meet the deadline. The costs of the return are to be borne by the customer. Exceptions are justified complaints, which are to be clarified after prior telephone consultation. Unfree return shipments (i.e. without sufficient postage) will not be accepted. The return shipment must be made including delivered accessories in new and unused condition in a stable transport packaging. The right of withdrawal does not apply to the delivery of goods that are manufactured according to customer specifications or clearly tailored to personal needs.<\/span><\/p>

In case of an effective revocation the company rbCarbon refunds an already paid purchase price. If the customer is not able to return the received goods or service in whole or in part or only in a deteriorated condition, he has to pay compensation for the value, even if the deterioration is based on an intended use. The reduction in value may correspond to the total purchase price. The customer can avoid a reduction in value in particular by not using the goods as an owner would and by refraining from doing anything that would impair the value of the goods.<\/span><\/p>

Retention of title<\/b><\/p>

All delivered goods remain the property of the company rbCarbon Roncassaglia & Roncassaglia UG until full payment has been received.<\/span><\/p>

Applicable law, place of fulfilment and jurisdiction<\/b><\/p>

The law of the Federal Republic of Germany shall apply to the contracts.<\/span><\/p>

Place of fulfilment is the registered office of rbCarbon Roncassaglia & Roncassaglia UG, W\u00fcrmbachstrasse 86 85716 Unterschlei\u00dfheim, Germany.<\/span><\/p>

If the customer has no general place of jurisdiction in the Federal Republic of Germany, Munich shall be agreed as the place of jurisdiction. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the conclusion of contracts with rbCarbon shall be Munich.<\/span><\/p>
